Personal Injury

Unfortunately, many of our family, friends, and neighbors are injured by the negligent conduct of another. Finklea, Hendrick & Blake, LLC has successfully represented thousands of clients and recovered substantial sums on their behalf. The guidance of an experienced personal injury lawyer is a necessity in these cases. Limit complicated conversations to the insurance company and never sign documents without legal counsel. This could prejudice your case and limit your ability to collect damages in the future. Also, you need to make sure to seek medical treatment as soon as practical under the circumstances and avoid gaps in treatment.

Finklea, Hendrick & Blake, LLC offers a comprehensive approach to personal injury cases by handling issues of property damage, long-term medical care, accident investigation, identifying potentially liable parties, finding available insurance coverages and negotiating medical expenses to ensure the optimum recovery for the client.

Our client-focused practice has won hundreds of referrals from satisfied clients who received appropriate compensation for their very real injuries. Finklea, Hendrick & Blake, LLC is proud that its lawyers live in Florence and the Pee Dee area so we can be instrumental in supporting the community.

When you hire Finklea, Hendrick & Blake, LLC, you actually meet the attorney that is handling your case. You are not passed down to an out of town, inexperienced attorney rarely in the local office. Unlike law firms which taint the profession with misleading TV commercials and other advertising, we do not only accept the easy cases, we accept the ones where we have to work for recovery!

Further, we often reduce our fees when necessary to net you a reasonable amount. Not only do we enhance your recovery by obtaining a larger offer from the insurance company, we work to obtain reductions from health insurance companies, lien holders, and medical providers to increase your recovery. Instead of stopping once we get your case settled with the liability carrier, we work to make you as whole as possible.

Dog Bites

According to the Centers of Disease Control and Prevention, over 4.7 million people each year are bitten by dogs in the United States.  Dog attacks can be devastating.   People experience serious injuries, disfigurement, and in some instances death.  Recovering from a vicious dog bite can involve visits to the emergency department, inpatient medical care, plastic surgery to reduce scarring, time away from work, and long-term pain and suffering.  Dog bites also carry the risk of transmitting dangerous diseases such as rabies, Pasteurella bacteria, and MRSA (methicillin-resistant Staphylococcus aureus).

South Carolina has a strict liability statute that holds dog owners or the person who is responsible for the care of the dog, liable for damages suffered by the person who is attacked.  South Carolina the victim does not have to argue about the history of the dog or if it was prone to attach.  Other states, however, have a “one-bite” rule, which precludes liability if the owner did not know of the dog’s dangerous propensities.  In other words, the dog can bite once with no liability to the owner. South Carolina does not follow this rule.

Because of the investigation required up front in these cases, it is important to consult with an attorney immediately.  Do not delay!  Our office has unfortunately handled far too many dog bit cases and if you are a victim of such a tragic incidence.

If you have been bitten by a dog and are in need of representation to obtain compensation for your medical expenses, lost wages, and suffering, contact the personal injury professionals at Finklea, Hendrick & Blake, LLC.  We are capable and understand the frustration that goes into handling your claim.  We will work with you to get the recovery you deserve.

Slip & Falls

Businesses have an obligation to ensure that their property is reasonably safe for customers, however some business owners are negligent and fail to eliminate or warn of hazards that lead to preventable injuries, such as slip and falls. A business is not the insurer of every guest’s safety. We must prove that the business was negligent in creating a dangerous condition or otherwise failed to remove a dangerous condition after notice. The Court precedent makes recovery in these cases very difficult; therefore, it is important to consult an attorney immediately to preserve the evidence and be advised before you speak with an insurance adjustor. In the event you provide a recorded statement and are misled by the leading questions of an insurance adjustor, your claim could be barred based upon an erroneous factual basis.

It is essential that businesses be held accountable for negligence when it comes to hazards, they are aware of and fail to address, resulting in serious or fatal injuries of visitors on their premises. If you or a loved one suffered injury from slipping and falling at a business and believe your injury was the result of negligence, contact the legal team at Finklea, Hendrick & Blake, LLC to discuss your case. We will work to get you compensation for your personal injury.

Wrongful Death

According to CDC.gov, approximately 213,596 people died in 2010 in the United States due to unintentional injury, fall, poisoning or motor vehicle accidents. In those instances, the family members are left to grieve and put together the pieces after the untimely death of their loved one. Wrongful death can occur as a result of the negligence of another in various settings such as death as a result of a car accident, a truck accident, an agricultural accident, a boating accident, instances of medical malpractice, a defective product, dangerous property conditions, a medical device which malfunctions, dangerous work conditions and other scenarios. Regardless of how it occurred, these are catastrophic cases affecting many people in the victim’s life. Fortunately, the law does provide a recovery when death results from the negligence of another. It is important that our office be contacted immediately so we can begin the investigation process and preserve evidence. We can take the necessary steps which will allow you to grieve appropriately.

If you or your friends or family have lost a loved one due to Wrongful Death as the result of the negligence of another, Finklea, Hendrick & Blake, LLC can help you find closure through bringing the responsible parties to justice and obtaining for financial compensation which you are entitled! A wrongful death claim is one holding another party liable for a person's death due to their negligence or misconduct. Those claims can be based on many circumstances.

However, here are some examples:

  •   Automobile Accidents Due to Another Driver
  •   Accidents due to defective property conditions
  •   Accidents due to defective equipment
  •   Accidents due to dangerous and unsafe working conditions
  •   Medical Malpractice

While monetary compensation cannot replace the loss of a loved one, holding negligent parties accountable and being financially secure in the untimely and unfortunate event of a wrongful death can help you and your family find closure. Consideration for a wrongful death lawsuit may not seem urgent; however, wrongful death cases should be investigated early to preserve important evidence and to avoid mistakes that may harm the claim.

If you believe a loved one has passed due to another person or entity's negligence or wrongful conduct, contact the attorneys at Finklea, Hendrick & Blake, LLC. Our lawyers are experienced in filing claims for monetary damages to which our clients are entitled.

Agricultural Accidents

Farm accidents are a grim and unfortunate reality of those working in agriculture. Death is often a single mistake away especially considering the multitude of machinery and implements which are utilized on a farm. The likelihood of injury increases based upon inadequate machinery, poor training, and lack of safety. Many traumatic injuries occur with exposure to machinery and especially tractors during maintenance or field work. Tractor fatalities usually result from tractor roll overs which could often be prevented with roll bars or seatbelts. Another leading cause are injuries involve implements being operated by power takeoff (PTO) or entanglements in machinery belts, chains, gears, crop gathering equipment and moving mechanisms. Many injured agricultural workers are not covered by workers’ compensation since there is a statutory exemption from requiring farm employers to maintain this coverage. Fortunately, many injured persons can find compensation by filing a liability claim. Most of the farmers that Finklea, Hendrick & Blake, LLC has encountered do in fact carry liability insurance. We have never lost an agricultural liability claim!

In agricultural accidents, it is imperative to seek legal assistance immediately. Preservation of evidence is key in these cases and therefore information must be gathered, and evidence documented. An adequate understanding of insurance coverages and the scope of loss which can be claimed is important to maximizing an injured worker’s claim or compensating that person’s family for wrongful death.

We understand the challenges facing injured farm workers. We know the worry and concern when the income stream stops, when there is no health insurance to provide for treatment, and uncertainty of if you will ever be able to return to work again! Rely on our experienced lawyers to navigate and pursue your claim.

Malpractice

Everyday we depend on professionals to provide services that support our and our family's well-being. In areas such as medicine, people rely on talented, knowledgeable, trained, and certified professionals to carryout duties that can have a lasting impact on their livelihood. However, when professionals do not provide a standard of care required of their profession that negatively impacts a patient, they must be held liable.

Malpractice occurs when a professional, such as a physician, is negligent in their performance leading to the injury of his or her client. Malpractice is the result of a professional’s performance not complying with industry standards and practices.

If you have suffered injury or a decline in your quality of life due to professional malpractice, contact the legal professionals at Finklea, Hendrick & Blake, LLC to discuss your case. We will put our knowledge and experience to work to get you the justice you deserve.
